Terms of Delivery and Payment

1.Orders
will only be accepted and executed in accordance with the following terms. Different terms on the part of the purchaser are only binding on us following our express agreement. Due to the possibility of transmission errors, in the event of ­telephone orders we cannot assume any guarantee for­ correct delivery.
2.Quotations are subject to change;
the right to make intermediate sales in reserved.
3.Collection.
You may collect the ordered goods from our ­ware­house after our agreeing to a collection date; in this event you will receive a 5% COLLECTION DISCOUNT on all articles.
4.On principle, shipping takes place at the expense and risk of the customer.
We deliver unfree and calculate a package-surcharge of € 2.50 per Package, as well as a postage-share per package plus VAT. Unfortunately orders less than € 25,00 cannot be delivered. Up to a net-merchandise-value of € 50.00 we calculate a surcharge of 10%. From € 250, - net-merchandise-value, delivery is package-surcharge free, from € 500 delivery is free within Germany. Export orders (within the EU), are delivered from € 500, - upwards postage free to the German border. The recipient carries the expenses from the German border up to the destination . To Austria, France and Switzerland, we deliver from € 750,00 postage paid. COD-expenses have to be paid by the customer!

Exception: Merchandise-group " honey-mead " and bee-pollen are always delivered unfree.

IMPORTANT!
We will not accept goods beeing returned to us without prior agreement.
5. Delivery guarantee.
We deliver as soon as possible and do our best to observe delivery deadlines. Should we be unable to ­observe a delivery deadline due to circumstances beyond our control or force majeure, a subsequent delivery deadline of two weeks following rectification of the circumstances in question shall be deemed to have been agreed to.
6. Damaged consignments.
Should you receive a damaged consign­­­ment, please have the damage ascertained by the ­authorities.
7.Complaints
will only be entertained within one week of the goods being received, and must be submitted in writing for verification purposes. In the context of the supplier’s warranty obligations, we guarantee perfect goods. Defects affecting part of a delivery do not entitle to a complaint in respect of the delivery as a whole. We are entitled to choose to either make retroactive improvements or a follow-on delivery. Other claims, in particular for compensation for other damage, are ruled out. Before making a complaint please remember that many of the articles involve natural products where the colour, smell and taste may vary, and thus do not constitute reasons for complaint.
8. Reservation of title.
The supplied goods remain our property ­until all demands arising from the business relationship have been met (in the case of payment by cheque, until the cheque has been cleared). The goods may only be sold by the ordering party in the context of normal commercial traffic. We reserve the right to revoke this agreement to resale of the supplied goods to which we have reserved title. Claims arising from the resale of goods to which we have reserved title must be assigned to us to secure our claims. In the event of there being a lien on the goods to which we have title, the ordering party is obliged to notify us imme­diately.
9.Our delivery obligation
presupposes that, in turn, the ordering party will meet or has met the obligations which it has undertaken, in particular those of a financial nature. Should the ordering party be in breach of these obligation we shall be released from the obligation to supply and shall be entitled to demand immediate payment of all outstanding invoices, including those which are not due, and shall be further entitled to repudiate orders which have not yet been processed.
10. Payment method: per invoice within 30 days net; per invoice ­within 10 days less 2 % discount; in the event of payment by bank debit, COD, advance payment or payment on the spot (in cash or by cheque) a 3% discount shall be applied. Deliveries for NEW CUSTOMERS will, on principle, be made COD with a 3% discount being applied. Samples up to the value of DM 30.00 will be supplied per invoice.
11. Buchen, Germany, is the place of performance and legal venue.
